• Registered Users - eBay has over 322,000 registered users in the state of Delaware.

• Top Sellers - Nearly 1,100 of those users qualify as Top Sellers. Top Sellers are members of the eBay community who sell over $1,000 worth of merchandise or services each month.

Issue/Policy Updates

• Streamlined Sales Tax Project (“SSTP”) - The SSTP is an attempt by some state governments to require out-of-state businesses (including Internet sellers) to collect and remit sales taxes to the states of all their buyers. Even assuming the SSTP effectively streamlines some portions of sales tax collection, small businesses would be forced to collect, remit and account for sales tax to buyers in thousands of separate taxing jurisdictions across America, a prospect which is unrealistic to all but the largest companies. Changing state and federal law in this way would impose a costly and complex new burden on small businesses using the Internet.

• E-Commerce -eBay opposes attempts to increase the regulatory burden on eBay-based small businesses. eBay works extremely hard to maintain a marketplace that is well-lit, safe and secure. Our commitment to transparency ensures that eBay sellers are held to the highest standards of conduct and sharply reduces the need for government regulation. At the same time, costly and unnecessary regulation has the potential to force existing small businesses to scale back or even close their operations. Excessive regulation also acts as a deterrent to the establishment of new online businesses, thus limiting future job creation.

• Retail Crime - eBay’s strong commitment to ensuring a safe, open, and transparent marketplace extends to our ongoing efforts assisting law enforcement. We swiftly respond to requests from law enforcement agencies and proactively help law enforcement officials investigate and prosecute users who attempt to sell stolen or illegal items. For the last eight years, eBay has also been holding seminars around the world to train law enforcement officers on best practices for gathering information from the site and successfully prosecuting crimes over the Internet. We believe that fighting back retail crime can best be accomplished through improved retailer inventory control, more law enforcement scrutiny of these crimes, and increased penalties for organized retail criminals.

In 2008, more than 15,000 buyers, sellers, and eBay employees will converge on Chicago June 19-21 for three days of classes, panels and exhibits aimed at creating a better online marketplace and more successful users.
